Guaranteed Issue Rights for Medicare Supplement Plans

Guaranteed issue (GI) rights give you the ability to buy a Medicare Supplement (Medigap) plan without going through medical underwriting. They apply in specific situations, most commonly when you lose other coverage. Knowing when your GI rights apply and acting quickly can protect you from being denied or charged higher premiums based on your health.

Normally, if you apply for a Medicare Supplement (Medigap) plan outside of your open enrollment window, insurance companies can review your health history and deny your application or charge you a higher premium. Guaranteed issue rights are federal protections that prevent insurers from doing this in specific qualifying situations.

Act Within 63 Days

Most guaranteed issue windows last only 63 days from the triggering event. Missing this window means you will likely face medical underwriting, which can result in higher premiums or denial of coverage. Do not wait.

What Is the Medigap Open Enrollment Period?

The most important guaranteed issue window is your Medigap Open Enrollment Period. It begins on the first day of the month you are both age 65 or older and enrolled in Medicare Part B. During this 6-month window, you can buy any Medigap plan sold in your state without medical underwriting, regardless of your health history. This is the best time to enroll in a Medigap plan, and missing it can make coverage harder and more expensive to obtain later.

Plans C and F: Important Note for New Enrollees

Medigap Plans C and F are no longer available to people who became eligible for Medicare on or after January 1, 2020. If you became Medicare-eligible before that date, you may still be able to purchase these plans. New enrollees are limited to the remaining standardized plans, with Plan G being the most comprehensive option currently available.

State-Level Guaranteed Issue Protections

Several states offer guaranteed issue protections beyond the federal minimums. States with birthday rules (including California, Oregon, Idaho, Illinois, Nevada, and others) allow you to switch Medigap plans once per year around your birthday without underwriting. Massachusetts, Minnesota, and Wisconsin have their own Medigap frameworks with additional protections. Check your state insurance department for rules specific to where you live.
